Terms of Use.
These Terms of Use ("Terms") govern access to and use of stefdphoto.com (the "Site") and the photography and video services offered by STEFDPHOTO ("we," "us"). By accessing the Site or engaging STEFDPHOTO, you agree to these Terms. If you do not agree, do not use the Site or engage our services.
1. Use of the Site
The Site is provided for informational and commercial inquiry purposes. You agree to use the Site only for lawful purposes and in a manner that does not interfere with the Site, its underlying infrastructure, or other users. You may not attempt to gain unauthorized access to any portion of the Site, copy or scrape Site content programmatically, or use any automated means to collect information from the Site.
2. Intellectual property
All photographs, video, written copy, layouts, designs, code, and other materials on the Site are the property of STEFDPHOTO or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or otherwise exploit any Site content without express written permission. Use of client deliverables is governed exclusively by the license terms of the related project agreement.
3. Bookings, quotes, and project agreements
Information presented on the Site, including pricing and service descriptions, is intended as a general overview and does not constitute a binding offer. Final pricing, scope, deliverables, deadlines, license terms, cancellation terms, and other commercial terms are governed by a written project agreement entered into between STEFDPHOTO and the client. STEFDPHOTO may require a deposit, signed agreement, or other documentation before scheduling work.
4. Third-party content and services
The Site may include links to third-party sites and services, embed third-party content (such as map data and video players), and integrate with third-party tools (such as form processors). STEFDPHOTO does not control and is not responsible for third-party content, services, or practices, and the inclusion of third-party links or embeds does not imply endorsement.
5. No warranties
THE SITE AND ALL CONTENT ON IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STEFDPHOTO DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. STEFDPHOTO MAKES NO REPRESENTATION THAT THE SITE OR ITS CONTENT WILL MEET ANY PARTICULAR REQUIREMENT OR THAT ANY DEFECT OR ERROR WILL BE CORRECTED.
6. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL STEFDPHOTO, ITS PRINCIPALS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SITE, ITS CONTENT, OR ANY SERVICES DESCRIBED ON THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF STEFDPHOTO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. STEFDPHOTO'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). LIABILITY ARISING OUT OF A SIGNED PROJECT AGREEMENT IS GOVERNED BY THAT AGREEMENT.
7. Indemnification
You agree to defend, indemnify, and hold harmless STEFDPHOTO and its principals, employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another party.
8. Pricing and changes
Pricing displayed on the Site reflects starting points only and is subject to change without notice. Final pricing for any project is provided in a written quote and governed by the related project agreement. STEFDPHOTO may modify or discontinue any aspect of the Site at any time without notice.
9. Governing law and venue
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-laws principles. The exclusive venue for any action arising out of or relating to these Terms or the Site is the state or federal courts located in Sacramento County, California, and the parties consent to the personal jurisdiction of those courts.
10. Severability and entire agreement
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be construed to the greatest extent permitted by law to reflect the original intent. These Terms, together with the Privacy Policy and any applicable project agreement, constitute the entire agreement between you and STEFDPHOTO concerning the Site.
11. Changes to these Terms
STEFDPHOTO may update these Terms from time to time. The "Updated" date at the top of this page reflects the current version. Continued use of the Site after the effective date of any update constitutes acceptance of the updated Terms.
